Under section 43A(6) of the Bankruptcy Ordinance (Cap. 6), an undischarged bankrupt is required to submit to the trustee of the property of the bankrupt (“the trustee”) on each anniversary of the making of the bankruptcy order against him, an Annual Statement of Earnings and Property Acquired. A bankrupt may be prosecuted and liable upon conviction to imprisonment for 6 months if he/she fails to comply with this requirement. In addition, the trustee or a creditor can also object to a discharge of a bankrupt under section 30A(4)(h) of the Bankruptcy Ordinance (Cap. 6).
For bankruptcy cases in which the Official Receiver acts as the trustee, the bankrupt can login the Public Portal of the Electronic Submission System to submit the Annual Statement of Earnings and Property Acquired. Upon successful submission, a confirmation message will be sent to the bankrupt via SMS or email.
